MARKETING

The legal basis for the processing of personal data for marketing purposes is the user’s consent.

In the event that a prior contractual relationship exists with the user, and provided that DIANTUM has obtained the contact information of the recipient in a lawful manner and uses it to send commercial messages related to products or services of its company that are similar to those that initially motivated the contractual relationship with the client, the legal basis will be the legitimate interest, especially in that which pertains to paragraph two of article 21 of Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

In the event that the data provided by the user is contact information of individual businesspersons or freelancers, the legal basis for the processing is a legitimate interest pursuant to article 19 of Organic Law 3/2018 of December 5, on Protection of Personal Data and Guarantee of Digital Rights, in relation to article 6(1.f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.

QUALITY SURVEYS DIANTUM has a legitimate interest in performing quality surveys among users with the purpose of analyzing the users’ satisfaction with this website, the quality of customer service or in relation to hired products and/or services.

The duration of personal data retention will depend on the purpose for which it was collected:

QUALITY SURVEYS Personal data processed for this purpose will be retained as long as necessary to perform the necessary actions to improve our service, our products or the usability of this website, depending on the reason for the survey, or until DIANTUM anonymizes the collected data.

The user is hereby informed that DIANTUM will retain the personal data, duly safeguarded, during a period in which civil, commercial, administrative, criminal or fiscal liabilities could arise, pursuant to the laws in effect at any given moment and until the statute of limitations on them has expired. Once these periods have expired, the personal data will be deleted.

DIANTUM informs that, in order to fulfill the purposes stated above, it is necessary for the users’ personal data to be provided to companies related to DIANTUM, as well as companies that support the services that we offer in a capacity of data processors, such as:

  • Technology services providers
  • Providers of services related to customer care
  • Providers of services related to the management of DIANTUM
  • Marketing and advertising service providers

In addition, the user is hereby informed that the personal data may be sent to Public Bodies when so required by the laws in effect.

DIANTUM outsources to data processors outside the EU certain functions that are necessary for the provision of the service. In such cases, we inform that the data is transferred while maintaining the safety of the data being processed, since adequate tools are used for the international transfer of the data, such as standard contract clauses and other applicable legal measures to guarantee an adequate level of protection over the personal data.

Video surveillance at DIANTUM’s facilities

DIANTUM’s facilities are equipped with cameras and/or video cameras which capture personal data (image and sound). Users are informed that they will find a sign in DIANTUM’s facilities with essential information regarding the processing of personal data. With the purpose of supplementing that information, we provide users with the table below which thoroughly explains the data processing.

LEGAL BASIS FOR THE PROCESSING DIANTUM has a legitimate interest to capture images through cameras or video cameras with the purpose of guaranteeing the safety of individuals, goods and its installations, as well as controlling the employees (employment relationship). The duty to inform will be deemed to have been fulfilled by affixing a notice in a sufficiently visible location, informing the existence of the processing, the identity of the controller and the possibility of exercising the corresponding rights.

User rights

The users who have provided personal data for DIANTUM to process have the following rights:

RIGHT TO ACCESS The user has the right to obtain from DIANTUM confirmation on whether the user’s personal data is being processed, as well as to access the personal data held by DIANTUM.
RIGHT TO RECTIFY The user has the right to request that DIANTUM rectifies the user’s inaccurate data. The user shall also have the right to have any personal data that is incomplete to be completed, even by means of an additional declaration.
RIGHT TO DELETION/RIGHT TO BE FORGOTTEN The user shall have the right to have DIANTUM delete the user’s personal information, always taking into consideration the requirements set forth in the laws in effect.
RIGHT TO RESTRICT PROCESSING The user shall have the right to request DIANTUM to restrict the processing of personal data, always taking into consideration the requirements set forth in the laws in effect.
RIGHT TO PORTABILITY The user shall have the right to receive from DIANTUM the user’s personal data in a structured, commonly used, machine-readable format, and to transfer it to another data controller when the processing is grounded on consent or on a contract, and performed through automated means.
RIGHT TO OBJECT The user has the right to object to DIANTUM processing the user’s personal data when the grounds for the processing are a legitimate or public interest. In this case, DIANTUM shall stop processing the data unless lawful exigent reasons exist, or it is necessary for the filing of, or defense in, potential claims.
INDIVIDUAL AUTOMATED DECISIONS The user shall have the right to not be subject to decisions based solely on automated processing, including the generation of profiles, that have a legal effect on the user or has a comparable significant effect, always in consideration of the requirements set forth in the laws in effect.
RIGHT TO LODGE A COMPLAINT The user has the right to lodge a complaint with the Spanish Data Protection Agencythe user considers that the aforementioned rights are being violated or if the user considers that the processing of the user’s personal data violates Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 and Organic Law 3/2018 of December 5, on Protection of Personal Data and Guarantee of Digital Rights.

Social Networks

DIANTUM is present in the most important social networks: LinkedIn and X. For that reason, it takes the role of Data Controller in relation to the data entered in its profiles resulting from friends, likes, followers, comments, pins, etc. 

The user expressly agrees to be subject to the privacy terms and conditions established by the various social networks and/or platforms where DIANTUM participates, allowing it to use the means provided by them to inform the users about its various activities and services.

Minors

Children under 14 years of age may not use the services available on this website without prior authorization by their parents or legal guardians, who shall be solely liable for all of the acts performed by the minors under their care on this website, including the completion of the forms with the personal data of said minors and checking their accompanying boxes, where applicable.

In relation to the above and considering that DIANTUM does not have the capacity to control whether the users are minors, it shall be the responsibility of the parents or legal guardians to implement the necessary measures to prevent the minors from accessing this website and/or providing personal data without their supervision. DIANTUM shall be held harmless from any and all liability in that regard.

Security applied to personal data

With the purpose of guaranteeing the safety and integrity of the provided personal data, DIANTUM has implemented the necessary technical and organizational measures to avoid data loss, as well as processing or access by unauthorized third parties, as required by the laws in effect on the matter and as per the state of the art and the nature of the stored data.

Changes in the privacy policy

DIANTUM reserves the exclusive right to update this Privacy Policy at any moment based on the needs of the website and future changes in the law in the matter of privacy.

Should such modification take place, DIANTUM shall inform the user of those changes if they are significant for the user’s privacy, allowing the introduced changes to be reviewed to consider whether to object to the personal data processing or unsubscribe from any service or feature. If consent is required to process personal data for purposes other than those specified herein, the user’s consent shall be sought as required by the provisions set forth in the data protection regulation in effect at the time.
